By accessing or using our services, including submitting a service request, scheduling a consultation, or accepting a quote, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.
Company: Refers to TWEAKY, LLC, operating the website https://tweaky.ai.
Client: Refers to the individual or entity engaging the Company for Services.
Website: Refers to the Client's website(s) that are the subject of the Services.
Services (or "Tweaks"): Refers to the specific website fixing, optimization, customization, and troubleshooting tasks agreed upon in the Fixed-Price Quote, including but not limited to performance optimization, technical glitch repair, SEO improvements, design fixes, API/integration repair, and e-commerce troubleshooting.
Quote: The fixed-price, no-obligation document provided by the Company to the Client detailing the scope of work and total cost for the requested Services.
All Services are provided based on an estimated price Quote issued after the Client submits a detailed request.
The Company's obligation is strictly limited to the tasks explicitly defined within the accepted Quote.
Any request for work or troubleshooting necessary to complete the Services that was not apparent or documented at the time of the initial request will be deemed "out-of-scope." The Company will inform the Client and provide a new or updated Quote, which must be approved before work continues.
The Company strives to complete most common tweaks within 1-3 business days. However, all completion timeframes are estimates and may vary based on information received or discovered. The Company is not liable for delays caused by factors outside its reasonable control, including but not limited to the Client’s delay in providing necessary information, access, or feedback.
The Client acknowledges that during the provision of Services (e.g., performance testing, updates, or code changes), the Website may experience temporary outages, technical malfunctions, or display unexpected visual changes. The Company will strive to minimize disruption but is not liable for minor, temporary interruptions outside the control of the company.
4.1 Required Access: To perform the Services, the Client must provide the Company with temporary, secure access to the Website's administrative backend (CMS/Platform login) and, if required, hosting panel, FTP/SFTP, or database access.
4.2 Data Backup: The Client is solely and entirely responsible for backing up all Website data, files, databases, and assets prior to providing access to the data. While the Company implements standard precautions to protect data, the Client agrees that the Company shall not be liable for any loss of data, content, or files that may occur during the execution of the Services.
4.3 Legal Compliance: The Client is solely responsible for ensuring that their Website and its content comply with all applicable laws, regulations, and third-party rights.
4.4 Authorization: The Client warrants that they have the necessary authority to contract for the Services and grant the required access to the Website.
5.1 Payment: Payment for the Services is due as specified in the Quote. The Company may require a full or partial upfront payment before commencing work. All fees are in US Dollars unless otherwise specified.
5.2 Satisfaction Guarantee: The Company offers a 100% Satisfaction Guarantee. If the Client is not satisfied with the delivered fix, they must notify the Company within 7 days of delivery. The Company will attempt to resolve the dissatisfaction through additional work, up to and including a full refund, at the Company’s sole discretion, if the defined scope of work was not completed.
5.3 Issue Reappearance Guarantee: If the exact issue fixed by the Company reappears within a specified timeframe (e.g., thirty (30) days) of completion, the Company will address and re-fix it at no additional charge. This guarantee is void if the issue is caused by the Client or a third party making subsequent modifications to the Website, installing incompatible software, or failing to follow Company recommendations.
5.4 No Guarantees of Results: While Services are intended to improve website performance, SEO, or user experience, the Company makes no guarantee regarding specific outcomes, including but not limited to: search engine ranking, sales volume, conversion rates, or traffic increase.
In no event shall TWEAKY, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory. In no event shall TWEAKY, LLC's total liability exceed the total amount paid by the Client for the Services
These Terms shall be governed and construed in accordance with the laws of the State of South Carolina, United States, without regard to its conflict of law provisions.Any disputes arising under these Terms will be settled through binding arbitration in the State of South Carolina
